Welcome to Hercuddle (the "App"). The App is developed and operated by Hercuddle ("we," "us," or "our"). It is the companion app for Hercuddle smart devices (such as Vionne): you can connect your device over Bluetooth and check its battery, use Custom Mode, sync haptics with music, and review your Usage Report.

Because the App is used for intimate wellness, we treat everything you do in it as sensitive. This policy explains what information the App may access, how we use it, how long it is kept, and what rights you have, including specific rights for residents of the United States and Canada. Please read it carefully before using the App.

Summary (Key Points):

  • The App does not require account registration;
  • Your device list, control settings, usage records, and imported music are processed and stored locally on your phone only—the current version does not upload them to our servers;
  • We do not sell or share your personal information, do not use it for targeted advertising, and do not collect consumer health data;
  • The App contains no ads, does not use third-party analytics or tracking tools, and does not use the advertising identifier;
  • The only permission the App asks for is Bluetooth, used to connect to your Hercuddle device. The App does not use your location;
  • The App and Hercuddle devices are intended for adults aged 18 and over (or the age of majority where you live, if higher).

1. Scope

This Privacy Policy applies to all features of the Hercuddle iPhone app that you download from the Apple App Store, including device connection, My devices (device details, session history, rename, and delete), Custom Mode (No Limits, Shortcut, Quadrants), Music Sync, Usage Report, and Contact Us. The App is offered primarily to users in the United States and Canada.

Services provided by Apple (such as the App Store, the system file picker, and iCloud Backup) and your email app are governed by their own privacy policies.

2. Information the App May Access

Please note: the App operates primarily locally on your device. "Access" in this policy means the App reads or temporarily uses relevant information on your phone to provide its features—it does not mean we collect, send, or store that information on our servers.

Information Type When Accessed Purpose Leaves Your Phone?
Device information When you search for, connect to, or use your Hercuddle device Identify and connect your device; show its name, connection status, and battery level and charging state (device and charging case). The device also reports its working status and sensor readings; the App uses them only while connected and does not save them No—exchanged only between your phone and your device over Bluetooth
My devices When you add, connect to, rename, or delete a device Remember the devices you added (Bluetooth identifier, device name, the custom name you set, when it was added and last connected, and how many times it connected), so the App can automatically reconnect to your default device and show its details. A custom name is saved only in the App and is not written to the device No—stored locally on your phone
Control settings When you choose a waveform, adjust intensity, or bind waveforms to quadrants in Custom Mode Remember your preferences for next time No—stored locally on your phone
Usage records When you use Custom Mode or Music Sync Record the mode, start and end time, duration, the device connected at the time (if any), waveform and intensity changes, and music playback actions (select, play, pause, seek, speed), so that Usage Report and Device Details can show your sessions and replay them No—stored locally on your phone
Imported music When you choose an audio file through the system file picker Copy the selected file into the App, read its title, artist, album, artwork, and duration, play it, and prepare its haptic pattern on your phone; remember your playlist No—stored locally on your phone
Emails you send us When you tap "Contact us" and send an email Reply to and resolve your request Yes—sent by your email app to us, containing your email address and whatever you choose to write

In addition:

  • When importing music, the App can only access the file you choose in the system file picker; it does not browse your other files;
  • The App does not request access to your contacts, photos, microphone, camera, or health data, and does not use your location;
  • The App does not collect your name, phone number, advertising identifier, or other identifiers;
  • If you choose to share analytics with app developers in your iPhone settings, Apple may share crash and diagnostic information with us so that we can fix problems. This information is handled under Apple's privacy policy and is not used to identify you.

3. Permissions

The App requests the following permission only when you use the related features. You may revoke it at any time in your iPhone's settings; after revocation, the corresponding feature will be unavailable.

3.1 Bluetooth

  • Why needed: To find and connect to your Hercuddle device, automatically reconnect to your default device, and read its battery and working status.
  • How we use it: The App communicates only with Hercuddle devices, and only while the App is open; it does not use Bluetooth in the background. Data exchanged with your device stays between your phone and the device and is not uploaded.
  • Can you decline? Yes. Without Bluetooth access you can still open the App and view your usage records and music library, but you will not be able to connect to your device.

3.2 Files

  • Importing music uses the system file picker and does not require any permission. Only the audio file you select is copied into the App.

To revoke Bluetooth access, go to Settings → Privacy & Security → Bluetooth, or Settings → Apps → Hercuddle.

4. How We Use This Information

We use the above information only as necessary to:

  1. Connect to your Hercuddle device, automatically reconnect to your default device, and show its status and battery level;
  2. Save and restore your device list, Custom Mode settings, music library, and playlist;
  3. Generate your Usage Report, session previews, and replays;
  4. Respond to the questions and feedback you send us;
  5. Ensure the App operates properly and comply with applicable laws and regulations.

We do not use your information for advertising, profiling, or automated decision-making, and we do not sell your personal information.

5. Data Retention and Deletion

  • Where stored: Your device list, control settings, usage records, and imported music are saved in the App's private storage on your phone. Other apps cannot access them.
  • Devices: Open a device's Device Details and tap Delete Device. The device and the usage records associated with it are deleted together.
  • Imported music: Touch and hold a song in the Music library and tap Delete; its audio file, artwork, and haptic pattern are deleted together. Built-in demo songs cannot be deleted.
  • Usage records: Kept on your phone until you delete the associated device or uninstall the App. The current version does not provide in-app deletion of individual sessions, or of sessions recorded while no device was connected.
  • Deleting everything: Uninstalling the App deletes all data it stored locally.
  • No account: The App has no accounts, so there is no account data for us to delete.
  • Backups: Depending on your settings, data in the App's storage may be included in your iCloud or computer backups and restored with them. Those backups are managed by you and Apple.
  • Emails: We keep your emails only as long as needed to handle your request and any follow-up, or longer if required by law. You can ask us to delete them at any time.

6. Sharing with Third Parties

We do not sell, rent, or share your personal information with any third party, except:

  • Service providers: Our email hosting provider stores and delivers the emails you send us, solely on our behalf and under our instructions;
  • With your consent: When we have obtained your explicit consent in advance;
  • Legal requirements: When required by law, court order, or a lawful request from government authorities, or to protect the rights and safety of you, us, or others.

The App does not integrate any third-party advertising, analytics, or user tracking services and does not track you across other companies' apps or websites. On iOS, the App will not show the "Allow App to Track" request.

7. Information Security

We take the following measures to protect your information:

  • Your device list, settings, usage records, and music are processed and stored locally, protected by the iOS app sandbox and data protection;
  • The App communicates over Bluetooth only with Hercuddle devices;
  • The App does not transmit your data to our servers, so it is not exposed to network transmission;
  • We follow Apple platform security guidelines and promptly address known issues.

Your usage records relate to private activities. Please set a screen lock on your phone and take care when lending your phone or sharing your screen.

8. Your Rights

You have the following rights:

  • View: View your sessions in Usage Report, your devices and their session history in Device Details, and your songs in the Music library;
  • Modify and delete: Rename or delete devices, change your Custom Mode settings, delete imported songs, or delete all local data as described in Section 5;
  • Revoke permissions: Turn off Bluetooth access in your iPhone's settings;
  • Requests about information we hold: Ask us to access, correct, or delete the emails you have sent us;
  • Inquiries and complaints: Contact us via the email at the end of this document.

Because the data stored in the App stays on your phone, we cannot view, export, or restore it for you. We will acknowledge your request within 15 business days and respond within the time required by applicable law. Additional rights for U.S. and Canadian residents are described in Sections 9 and 10.

9. Notice to U.S. Residents

This section supplements this policy for residents of U.S. states with consumer privacy laws, including California (CCPA/CPRA), Colorado, Connecticut, Virginia, Utah, Texas, Oregon, and others, as well as Washington's My Health My Data Act and Nevada's consumer health data law.

9.1 Personal information we collect

In the preceding 12 months, the only personal information we have collected through the App is:

  • Identifiers: your email address, when you email us;
  • Customer communications: the content of your emails, which may include any information you choose to provide.

Source: directly from you. Purpose: to respond to your request. Disclosed for a business purpose to: our email hosting provider. Retention: as described in Section 5.

9.2 Sensitive personal information and consumer health data

Information about how you use an intimate wellness device—such as your usage records and the status your device reports—may be considered sensitive personal information (relating to your sex life or sexual health) or consumer health data under some state laws. This information stays on your phone. We do not collect, share, or sell it, and we do not use it to infer characteristics about you.

9.3 No sale, sharing, or targeted advertising

We do not sell personal information, do not "share" it for cross-context behavioral advertising, do not use it for targeted advertising or profiling, and have not done so in the preceding 12 months. We have no actual knowledge of selling or sharing personal information of consumers under 16.

9.4 Your rights

Depending on your state of residence, you may have the right to:

  • Know and access the personal information we have collected about you;
  • Correct inaccurate personal information;
  • Delete personal information we have collected from you;
  • Obtain a portable copy of your personal information;
  • Opt out of the sale or sharing of personal information, targeted advertising, and profiling (we do not engage in these activities);
  • Limit the use of sensitive personal information (we do not use it beyond what is permitted by law);
  • Not be discriminated against for exercising any of these rights.

To make a request, email us at support@hercuddle.com from the email address related to your request. We will verify your request by confirming that you control that email address. You may use an authorized agent to make a request on your behalf; we may ask the agent to provide proof of your written permission. If we deny your request, you may appeal by replying to our decision with the subject line "Appeal." If your appeal is denied, you may contact your state Attorney General.

9.5 Do Not Track and Global Privacy Control

Because we do not track users across websites or apps, or sell or share personal information, we treat every user as opted out. Do Not Track and Global Privacy Control signals therefore do not change how the App works.

9.6 California "Shine the Light"

We do not disclose personal information to third parties for their own direct marketing purposes.

10. Notice to Canadian Residents

We handle personal information in accordance with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial laws, including Quebec's Act respecting the protection of personal information in the private sector (as amended by Law 25).

  • Consent: By using the features described in this policy, you consent to the handling described here. You may withdraw consent at any time by revoking permissions, deleting data, uninstalling the App, or contacting us, subject to legal or contractual restrictions;
  • Access and correction: You may request access to, and correction of, the personal information we hold about you;
  • Storage outside Canada: Emails you send us may be stored and processed by our email hosting provider in the United States or other countries, where they may be accessible to courts and authorities under the laws of those countries;
  • No profiling technology: The App does not use technology that identifies, locates, or profiles you, and makes no decisions about you based solely on automated processing;
  • Person in charge of privacy: Our Privacy Officer is responsible for the protection of personal information and can be reached at support@hercuddle.com;
  • Complaints: If you are not satisfied with our response, you may contact the Office of the Privacy Commissioner of Canada (priv.gc.ca) or your provincial privacy regulator, such as the Commission d'accès à l'information du Québec (cai.gouv.qc.ca).

11. Protection of Minors

The App and Hercuddle devices are adult products intended only for people aged 18 and over (or the age of majority where you live, if higher). The App is not designed for or directed at children, and we do not knowingly collect personal information from children under 13 or from anyone under 18. If you are under that age, please do not use the App. If a parent or guardian believes a minor has provided us with personal information, please contact us and we will delete it promptly.

12. App Store Privacy Details

Apple requires developers to disclose how apps handle data on the App Store page. The actual practices of this App are as follows:

  • No data collected: The App does not send your device list, settings, usage records, or music to us or any third party;
  • No data shared: No data is shared with third parties;
  • No tracking: The App does not track your activity across other companies' apps or websites, and does not use the advertising identifier;
  • No third-party services: No advertising, analytics, or tracking third-party tools are used;
  • Clear permission purposes: Bluetooth is used only for the purposes described in Section 3.

The privacy information shown on the App Store page is based on what we submit to App Store Connect; if there is any discrepancy, this policy shall prevail.

13. Future Features

We may later offer features that require sending data to our servers, such as accounts or AI Mode. Before any such feature takes effect, we will update this policy to explain what is sent, why, and how long it is kept, and will obtain your consent where required—including your opt-in consent before collecting any sensitive personal information or consumer health data.

14. Policy Updates

We may update this policy from time to time. Updates will be posted on this page with a revised "Last Updated" date at the top. If changes materially affect your rights, we will notify you through in-app notices or other means before they take effect. Continued use of the App after an update constitutes acceptance of the revised policy, except where your consent is required by law.
